USER AND MEMBERSHIP AGREEMENT

1. PARTIES

This User and Membership Agreement ("Agreement"); between Ametist Istanbul Trade Inc. ("Ametist Istanbul"), the owner of the website www.ametististanbul.com and mobile applications, located at “Esentepe Mahallesi Kore Şehitleri Caddesi Onurgil İş Merkezi No:35 K:3 D:5 Şişli/Istanbul”, and the internet user or mobile application user ("Member") who becomes a member by accepting the following terms, has been concluded in order to determine the conditions regarding the Member's use of the services offered by Ametist Istanbul.

Ametist Istanbul and the Member shall be referred to individually as "Party" and collectively as "Parties".

2. DEFINITIONS

• User: A person who visits the Site and Application with or without making a purchase.
• Member: A natural or legal person who wishes to benefit from Ametist Istanbul services by purchasing products and whose membership is approved after fully completing the Membership Form ("Form").

Users who have completed the age of 18 (eighteen) may become members by filling out the Form on the Site with their real identity information. Legal entities may also become members through their authorized representatives.

3. SUBJECT OF THE AGREEMENT

This Agreement covers the rights and obligations of the Member regarding the use of the services offered by Ametist Istanbul through the Site and Application. By approving this Agreement, the Member declares and undertakes that they are aware of all their obligations.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. In order to obtain membership status, the User who wishes to become a Member must approve this Agreement on the Site and/or Application, fill in the requested information accurately and up to date, and the membership application must be approved by Ametist Istanbul.

4.2. The Member agrees to act in accordance with this Agreement, the rules on the Site, applicable legislation, and moral principles in all transactions carried out on the Site and Application.

4.3. The Member accepts that the contact information provided in the Form is accurate and that Ametist Istanbul may contact them through this information.

4.4. All materials on the Site and Application belong to Ametist Istanbul and cannot be used, copied, or distributed without permission.

4.5. Ametist Istanbul is not responsible for price and content errors caused by system errors and reserves the right to cancel erroneous orders.

4.6. Ametist Istanbul cannot be held responsible for any damages arising from the Member's transactions on the Site and Application.

4.7. Ametist Istanbul has the right to suspend, cancel, or terminate membership without giving any reason.

5. CONFIDENTIALITY

The personal data provided by the Member on the Site and Application will be processed and protected in accordance with the Law on the Protection of Personal Data. The Member expressly consents to the use of their personal data in accordance with this law.

6. FORCE MAJEURE

In cases of force majeure, Ametist Istanbul shall not be liable for failure to fulfill its obligations under this Agreement.

7. EFFECTIVENESS

This Agreement shall be deemed to have entered into force upon the Member's approval of the Agreement or use of the Site.

8. COMPETENT COURT

In any disputes arising from this Agreement, Istanbul Courts and Enforcement Offices shall have jurisdiction.

This Agreement is specific to www.ametististanbul.com and users who wish to become members shall be deemed to have accepted these terms.
