USER AND MEMBERSHIP AGREEMENT

1. PARTIES

This User and Membership Agreement (“Agreement”) is entered into by and between Ametist Istanbul Trade Inc. ("Ametist Istanbul"), the owner of www.ametististanbul.com and its mobile applications, located at "Esentepe Mahallesi Kore Şehitleri Caddesi Onurgil İş Merkezi No:35 K:3 D:5 Şişli/Istanbul", and the user of the website ("Site") or mobile application ("Application") who accepts the following terms and becomes a member ("Member").

Ametist Istanbul and the Member shall be referred to individually as a “Party” and collectively as the “Parties” in this Agreement.

2. DEFINITIONS

• User: A person who visits the Site or Application with or without making a purchase.
• Member: A natural or legal person who wishes to benefit from Ametist Istanbul's services and is approved by Ametist Istanbul upon completing the Membership Form ("Form") accurately and completely.

Users who are 18 years or older may become members by providing their real identity information and completing the Form on the Site. Legal entities may also become members through their legal representatives.

3. SUBJECT OF THE AGREEMENT

This Agreement governs the rights and obligations of the Member concerning the use of the services provided by Ametist Istanbul through the Site and Application. By approving this Agreement, the Member declares and undertakes that they are aware of all their obligations under it.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. To acquire membership status, a User must approve this Agreement, provide the required information accurately and completely, and have their membership application approved by Ametist Istanbul.

4.2. The Member agrees to act in accordance with this Agreement, the rules of the Site, applicable legislation, and ethical standards when performing transactions on the Site and Application.

4.3. The Member acknowledges that the contact information provided in the Form is accurate and that Ametist Istanbul may contact them using this information.

4.4. All materials on the Site and Application are the property of Ametist Istanbul and may not be used, copied, or distributed without permission.

4.5. Ametist Istanbul is not responsible for errors in prices or content due to system malfunctions and reserves the right to cancel erroneous orders.

4.6. Ametist Istanbul shall not be held liable for damages arising from transactions carried out by the Member on the Site and Application.

4.7. Ametist Istanbul reserves the right to suspend, cancel, or terminate memberships at its sole discretion without providing justification.

5. CONFIDENTIALITY

The personal data provided by the Member on the Site and Application will be processed and protected in compliance with the Personal Data Protection Law. The Member explicitly consents to the use of their personal data in accordance with this law.

6. FORCE MAJEURE

Ametist Istanbul shall not be held liable for failure to fulfill its obligations under this Agreement due to force majeure events.

7. ENFORCEMENT

 

This Agreement shall enter into force upon the Member's approval of the Agreement or use of the Site.

8. JURISDICTION

In case of any disputes arising from this Agreement, the Istanbul Courts and Execution Offices shall have jurisdiction.

This Agreement is tailored for www.ametististanbul.com, and individuals wishing to become members are deemed to have accepted these terms.
